PREPARING THE PROPERTY FOR VIEWINGS

GET RID OF THE CLUTTER! 


Decide which items need to be removed, think of yourself when you bought your house and remember that people will favor a “show flat” rather than a “home” as they might not be able to picture themselves in it. 

The neutral colors and furniture of a show flat help identify oneself with the property. Go through your home and try to create that show flat effect.

DECORATION AND REPAIRS

 If you do decide to paint the walls, choose white or neutral colours.

VIEWING DAY You have gotten rid of the clutter, painted the walls, it’s now time to do a final check: 

• Make sure the kitchen has been cleared as much as possible off the worktops including cloths and washing up bottles from around the sink.

• The same applies to the bathroom(s). 

• Bedrooms – Tidy up the clothes (none lying around), the bed spread and pillows, make it look comfortable. 

• Children’s toys are to be put away. 

• Lounge - remove all personal mail, magazines etc. and arrange the pillows on the sofa, again make it look inviting.

• Buyers want to imagine a property as their home; too may personal effects around make it harder for them to imagine themselves in the property.

• Make sure the house is clean and tidy.

• Try not to make yourself available during the viewing as statically, the potential buyer will not spend much time in a home if the current owner is present. We want the buyer to spend as much time as possible in your home; we need them to feel comfortable and not obliged to rush so as to not inconvenience you.

• Lights. A property with lots of light makes rooms feel fresh so try to create as much natural light as possible. For the darker rooms it may be worth purchasing some small lamps to lighten up some areas.

 

• If there is an outside area or garden, bear in mind it will be the first impression, incredibly important, so make sure the lawn is cut and your driveway is swept. If the front door looks tired, brighten it up with a lick of paint. Put some plants or hanging baskets outside. Dress the windows with blinds or curtains as empty windows can make a property feel impersonal or run down. Tidy up the garden or terrace and wipe down the outdoor furniture.


Viewings flexibility is crucial, so it’s always best to leave us a copy of the keys if you are going away, or leave us details of where we can collect them. We always need to be able to access your property with prospective buyers, even at short notice.

 

• Presentation matters! Buyers are coming to look around your property, and you need to make an effort to show your home at its best. Don’t make buyers imagine how good it could be – show them! Decide on the strengths of your property and show them off. 


• Advertise the property as being on the market with one of our “FOR SALE” signs. 

Properties with For Sale signs prominently displayed receive more enquiries and viewings than a property without one.


To begin marketing your property we will need some key paperwork and documents:


• Photocopy of your Passport, NIE or NIF 

• Property registration document (Nota Simple) 

• Photocopy of the Deeds (Escritura) 

• Photocopy of the Energy certificate 

• Photocopy of the last IBI and Basura receipts 

• Photocopy of the last payment receipt for the community fees 

• Fist Occupation Licence or Certificate of Non – Infraction 

• Photocopy of the latest utility bills (Water and Electricity)

HOW MUCH IS MY PROPERTY WORTH?


Setting the correct price is probably the most important part of the selling process. 


We understand that as an owner, your main concern is to achieve the best possible price for your property….and so do we! 

However, setting the price too high will deter potential buyers, but setting it too low and you are potentially throwing money away. 

Try to refrain from choosing the estate agent who will readily offer the highest valuation as it will, in all likelihood, be unachievable and it’s probable that you’ll have to considerably lower the price in order to sell your home after much wasted time. 

Instead take your time and find out the true market value of your property.

SELLING COSTS


These are the costs when selling a property in Spain: 


Agency Fees

Listing your property with us is free. Sherlock Homes Marbella will only charge the agreed fee when a sale is completed through our agency. 


Legal fees 

Most lawyers charge 1% + IVA (VAT) of the agreed sales price, usually paid on completion of the sale. 


Plusvalía 

This is a one off tax levied by the local Tax Authorities. This is based on the increase in value of the land on which the property is situated since the property was last sold. We can calculate this figure for you. 


3% Retention (For Non-residents only) 

The purchaser is obliged to retain 3% of the declared sales price and pay the funds to the Spanish Tax Authorities. This is to guard against any taxes that may be owed in Spain, including Capital Gains Tax. If the seller can prove that all taxes have been paid and there is no Capital Gains then this money can be reclaimed. 


Capital Gains Tax 

This is based on the net profit of a sale. Capital Gains Tax for residents and Non EU residents is taxed at a flat rate of 21%. A resident of Spain is exempt from paying Capital Gains Tax if: 

  • The property is your main residence (owned for 3 years or more)
  • The full sales price is re-invested in another property as your main residence within 2 years
  • The new residence remains your main residence for the next 3 years


Residents over age of 65 and who have owned the property for 3 or more years (as their main residence) are also exempt from Capital Gain Tax.


WHY DO I NEED AN INDEPENDENT SPANISH SOLICITOR/LAWYER (ABOGADO)


Buyers and sellers alike often don't realise the importance of contracting the services of a qualified solicitor. Many have the misconception that they don't need a solicitor to complete their purchase or sale of a property because they can use a Notary Public instead. Their roles are totally different and one should not be used to replace the other. 

THE ROLE OF THE NOTARY Notaries are Spanish Government appointed officials who ensure that the correct legal processes are followed after the Title Deeds have been drawn up. They witness the sale and draft the formal documentation, registering the transaction on public record. They check for fraud, ensuring that the buyer and seller are who they say they are. They also ensure that payment for the property is given / received in accordance with the law and that the appropriate taxes are paid. Notaries do not act on behalf of the buyer or seller. If they realise that any of the terms and conditions within the Title Deeds are not in the best interests of either party, they are under NO obligation to tell you so. The Notary acts on behalf of the Spanish Government, not an individual. 

THE ROLE OF THE LAWYER/SOLICITOR using the services of an independent solicitor, who is an expert in Spanish property law, is vital in order to protect your interests. Buyers and sellers must never use the same solicitor as there is a conflict of interests. Usually, the best way to find a good solicitor is through personal recommendation. 

The solicitor acting on behalf of the seller: It is wise to get your solicitor started with the paperwork as soon as possible. If they have everything ready to give to the buyer's solicitor, it will make your sale proceed quicker.
